The Parent Education Program in New Jersey
In any New Jersey divorce case involving children, your first court appearance will be the parent education program. Your appearance is mandatory pursuant to N.J.S.A. 2A:34-123. The other parent will not be there with you because there are separate dates for plaintiffs and defendants. However, if there is a restraining order, you will not be attending. There is a $25 cost for the program but that is paid as part of the filing fee. Thus, you don’t have to bring anything or anyone. There is also no need to bring your lawyer.
Essentially, a family mediator will introduce parents to the process of family mediation. Additionally, a licensed clinical social worker will discuss the needs of children as they move through the difficult transitions of separation and divorce. Parents are given the opportunity to ask questions so that they can get a better understanding of how to handle the divorce with their children. The program largely consists of lecture, role play and a video presentation.
